1 General Provisions
1. These Terms and Conditions define the rules for using the online store Portugalski Świat Sp. z o.o., available at https://portugalskiswiat.com/ (hereinafter: the Store).
2. The Store is operated and owned by Portugalski Świat Sp. z o.o., located at Al. Jana Pawła II 45A lok 38B/2 (poziom -1), 01-008 Warsaw, Poland, VAT ID NIP 5272684328, authorized to sell alcoholic beverages directly to consumers and businesses.
3. These Terms define the rules for concluding sales contracts, order processing, data protection, and the rights and obligations of Customers and the Seller.
4. The Terms are available free of charge on the Store website and may be saved or printed.
5. Sales are made only to persons over 18 years of age. Age verification may occur upon delivery.
2 Definitions
• Store / Service – the website https://portugalskiswiat.com/.
• Seller – Portugalski Świat Sp. z o.o..
• Customer / User – any natural person (over 18), legal person, or organization using the Store.
• Consumer – a natural person making a purchase not related to professional activity.
• Product – goods offered for sale in the Store, particularly wines and alcoholic beverages.
• GDPR – Regulation (EU) 2016/679 (General Data Protection Regulation).
3 Orders and Payments
1. Orders can be placed via the Store’s website, either logged in or as a guest.
2. A sales contract is concluded upon confirmation of the order by the Seller.
3. Prices are stated in PLN, EUR, include VAT, and exclude delivery costs, which are shown separately.
4. Accepted payment methods: bank transfer, credit/debit card, cash on delivery, or online payment system (e.g. PayU, Stripe).
5. For business clients (B2B), invoices can be issued after verification of company details.
4 Delivery and Collection
1. Deliveries are carried out within Poland, the European Union, and Ukraine.
2. Deliveries are handled by PayU, Przelewy24, and similar on behalf of the Seller, or personal pickup is possible at Al. Jana Pawła II 45A lok 38B/2 (poziom -1), 01-008 Warsaw, Poland.
3. Standard delivery time: 1–5 business days in Poland, 3–10 business days in the EU or Ukraine.
4. The Customer is responsible for providing correct delivery details.
5. If a product is unavailable, the Seller will inform the Customer and offer an alternative, delay, or refund.
5 Withdrawal and Returns
1. Consumers may withdraw from the contract within 14 days of receiving the goods, without giving a reason.
2. The right of withdrawal does not apply to opened or damaged bottles.
3. Returns must be sent to: Al. Jana Pawła II 45A lok 38B/2 (poziom -1), 01-008 Warsaw, Poland.
4. Refunds are made within 14 days after receipt of the returned goods.
5. Return shipping costs are borne by the Customer, unless the product was defective or incorrect.
6 Complaints
1. Complaints should be submitted via e-mail to jlopes@portugalskiswiat.com.
2. The complaint should include the order number, description of the problem, and contact details.
3. The Seller will respond within 14 days.
4. If the complaint is accepted, the Customer may receive a replacement, repair, or refund.
7 Personal Data
1. The Data Controller is Portugalski Świat Sp. z o.o..
2. Personal data is processed in accordance with GDPR and the Privacy Policy available at http://portugalskiswiat.com/en/privacy-policy/.
3. Data is processed to fulfill orders, manage customer accounts, and for marketing purposes with consent.
8 Final Provisions
1. All sales contracts are concluded directly between the Customer and Portugalski Świat Sp. z o.o..
2. The governing law is Polish law.
3. For matters not regulated herein, the Civil Code, the Act on Electronic Services, and GDPR apply.
4. These Terms are valid from the date of publication on the Store’s website.
